Accra High Court Bans 12 Labor Unions From Embarking On Strike In Relation To Tier2 Pension Scheme 

A High Court in Accra, has upheld an interlocutory injunction brought against twelve labor unions in respect of an industrial action resulting from the control and management of the second tier pension scheme. 

The Court did not hesitate to grant the application by the Attorney-General, after it concluded per the evidence of the facts that the balance of convenience tilts in favor of the Attorney-General. 

This is because the AG raised serious and weighty issues in its application regarding the dispensation of justice.

According to the application the Labour Unions on October 21st this
year convened a forum to announce its intended strike, and this consequently induced workers to stay away from rendering service. 

This the application noted has over riding effects on third parties such as students and sick persons in the health sector. 

It also noted that the industrial action by the Unions can cause such irepairable financial loss and damage to the state. 

The Court upheld the position of the AG that there are more appropriate and convenient avenues for the Unions
to seek redress other than resort to a strike. 

Consequently trial Judge Justice Kwaku Saeed Gyan, has ordered the labor unions particularly the executive members to restrain from embarking on a strike over the tier Two pension scheme. 

The injunction is to take immediate effect until the final determination of the case. 

Justice
Gyan appealed to the parties to exercise restraint for the good of the country. 

The Court however had to adjourn the case sine-dine because an application by the Bank of Ghana, which was joined to the counter claim had not been served on the twelve labor unions.

Meanwhile, Counsel for the twelve Labour Unions, Godfred Yeboah Dame says they will appeal against the ruling because the substantive matter is still pending. 

Speaking to Radio Ghana, Mr. Dame said the ruling as it stands now means that their constitutional right to strike has been curtailed.
